1) Scope

1.1

These General Terms and Conditions (hereinafter referred to as the "Terms") of Babyloveshop (hereinafter referred to as the "Seller") apply to all contracts for the delivery of goods concluded between a consumer or trader (hereinafter referred to as the "Customer") and the Seller via this online shop.

1.2

A consumer is any natural person who enters into a legal transaction for purposes that are wholly or mainly outside their trade, business, craft, or profession.

1.3

A trader is a natural or legal person who acts in the exercise of their trade, business, craft, or profession when entering into a legal transaction.

2) Conclusion of Contract

2.1

The product descriptions displayed in our online shop do not constitute legally binding offers but are an invitation for the Customer to submit a binding order.

2.2

The Customer submits a binding offer by completing the online checkout process and clicking the button to place the order.

2.3

Where PayPal is selected as the payment method, payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, in accordance with PayPal's terms and conditions. Acceptance of the Customer's offer occurs once the order has been successfully completed.

2.4

The contract text is stored electronically and the Customer will receive an order confirmation by email. Additional access to the contract text is not provided unless the Customer has created an account with the store.

2.5

Before submitting an order, Customers may correct any input errors using the standard functions of their browser and device.

2.6

The contract language is English.

2.7

Communication relating to orders takes place primarily via email. Customers are responsible for ensuring that the email address provided is correct and capable of receiving our messages.

3) Right to Cancel

3.1

Consumers have a statutory right to cancel eligible distance purchases.

4) Prices and Payment Terms

4.1

All prices displayed in our online shop include any applicable taxes unless otherwise stated. Shipping charges are shown separately during checkout where applicable.

4.2

The available payment methods are displayed during the checkout process.

4.3

If PayPal is selected, payment processing is carried out by PayPal and may involve third-party payment providers.

4.4

Where Shopify Payments is available, payments are processed through Stripe Payments Europe Ltd., Dublin, Ireland, subject to Stripe's applicable terms.

5) Delivery and Shipping Terms

5.1

Orders are delivered to addresses within the delivery areas specified on our website.

5.2

If delivery cannot be completed because of incorrect information provided by the Customer or because the Customer fails to accept delivery, any reasonable additional delivery costs may be charged.

5.3

Risk passes to consumers upon delivery of the goods. For traders, risk passes once the goods have been handed to the carrier.

5.4

If a product becomes unavailable despite careful stock management, we reserve the right to cancel the order. Any payments already made will be refunded promptly.

6) Retention of Title

Ownership of the goods remains with Babyloveshop until full payment has been received.

7) Liability for Defects (Warranty)

The statutory consumer warranty rights applicable under the laws of England and Wales remain unaffected.

8) Applicable Law

These Terms shall be governed by the laws of England and Wales. If you are a consumer, you also benefit from any mandatory legal protections available under the laws of your country of residence where applicable.

9) Alternative Dispute Resolution

Babyloveshop is not obliged and does not agree to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law.
